3. THE CONTRACT BETWEEN US

This confirmation is provided by the payment company Braspag, Pagseguro and Paypal. The acceptance of your order by GISELI DIAS brings into existence a legally binding contract between us on these terms. Any terms imposed by you on your order will not form part of the contract.

Neither we nor our partners have any responsibility for lost profits, business, business interruption or business opportunity.
4. TERMINATION OF CONTRACT
If you are an individual and you are not purchasing goods on behalf of a business, there are certain circumstances in which you may terminate the contract and these are set out here. This right of withdrawal does not apply to business buyers.
The. You may cancel your order at any time up to the moment when GISELI DIAS notifies you that your order has been accepted and is being processed. You will not have to pay any fines.
B. In case the order is in the process of being processed, you cannot terminate the contract, but you can return the goods to us. Our returns policy is an integral part of your agreement with us and is described below in Exhibit A.
5. AVAILABILITY OF/OF ITEMS
If the purchased product is no longer in stock, the purchase will be canceled and the refund will be made as soon as possible and, in any case, within 7 working days from the date of cancellation request. GISELI DIAS will not be obliged to offer any additional compensation for the disappointment caused.
6. DELIVERY OF GOODS
The. GISELI DIAS will ship the products ordered by you on your behalf to the person and address you provide GISELI DIAS at the time you place the order.
B. Delivery will be made as soon as possible after confirmation of payment of the order, in any case, within 3 to 7 working days for national and international deliveries, counting from the date of completion of the analysis of the order. This analysis can take up to 48 working hours to complete. All delivery times quoted on the website are estimates only, based on availability, routine processing and company deliveries.

7. DELIVERY OF GOODS
Information about the countries in which we deliver can be found on the “frequently asked questions” page (available from the link ). There are restrictions on the delivery of some products to some countries, so we ask you to verify the information on the “frequently asked questions” page before finalizing the order.
When purchasing products for delivery to an international destination, your order will be subject to applicable import duties and taxes upon arrival at the destination. Please see 7(b) (above) for more information on taxes and fees. In some countries there is the possibility of contracting a local importer to facilitate customs clearance and delivery to the customer.
Buyer must comply with all laws and regulations in the country selected as the order’s destination. We are not responsible for violating these laws.
8. CUSTOMS FEES
The. Our prices include import tax, local taxes and customs duties, and these additional costs are not under the control of GISELI DIAS and are determined by Brazilian legislation.

If you report a problem to GISELI DIAS, through our website, communicating the lack of receipt of one or more products, or the receipt of a defective product, our team will contact you to advise you on how to proceed with the exchange or return of the product, remembering that the deadline to call the GISELI DIAS team is 03 (three) business days from the receipt of the goods, or 40 (forty) days from the date of purchase in case you have not received them

The responsibility of GISELI DIAS is limited to refunding the consumer up to 100% (one hundred percent) of the amount paid, fully refunding the amount paid or debited to their card, without any other type of refund, reimbursement or indemnity to the consumer end, and therefore, whatever the problem reported to our team, the end consumer will receive, at most, 100% (one hundred percent) of what they paid (including shipping and taxes).

13. APPLICABLE LAW
The contract between us will be governed by and construed in accordance with Brazilian law, and Brazilian courts are competent to resolve any dispute between us.
14. COMPLETE AGREEMENT
These terms and conditions, together with the current prices on the GISELI DIAS website, delivery details and contact details establish our agreement regarding the supply of goods to you by GISELI DIAS. These terms and conditions cannot be changed, except in writing and signed by a director of GISELI DIAS. In particular, nothing said by any sales person on behalf of GISELI DIAS should be understood as a variation of these terms and conditions, or as an authorized representation about the nature or quality of products offered for sale by GISELI DIAS. GISELI DIAS will not have any responsibility for any representation as being false or misleading.

21. IMPORT CONTRACT
AGREEMENT FOR THE PURCHASE AND SALE AND IMPORTATION OF PRODUCTS SOLD VIA INTERNET.
By this instrument, and in the best form of law, the parties identified below enter into the contract for the purchase and sale of imported products sold via the internet:
GD France – Foreign Entrepreneurial Society, headquartered in FRANCE, at 27 Rue Molière, 33110 Le Bouscat; France. registered with the Internal Revenue Service of Brazil under No. CNPJ/154695190001/90, GDR COMERCIO DE CALCADOS LTDA.
The INDIVIDUAL BUYER, through the respective electronic registration carried out on an internet shopping site, which requests the provision of services described herein, whose registration data will be those extracted from the acceptance signed via the website, in this act referred to simply as ” BUYER” for all purposes and, consequently, will form an integral part of this instrument. Both enter into this Purchase and Sale Agreement and import of products marketed on the website ‘www.giselidias.com”
For the purposes of executing this agreement, the words and expressions contained herein shall be understood in accordance with the following definitions:
1.1. “GISELIDIAS.COM”: legal entity whose business name is GISELI DIAS, which sells products whose sale is carried out via the internet, with which the BUYER, through prior registration made via the corresponding website, acquires the presented products.
1.2. BUYER (a): natural person, duly registered in the Register of Individuals (MF), who will accept the conditions of purchase of products offered via the internet by “GISELIDIAS.COM”, with which it is entering into commercial transactions.
1.3. WEBSITE: electronic page or electronic address (www.giselidias.com) via internet, whose ownership, operation and responsibility are under the responsibility of the company “GISELIDIAS”, in which the BUYER may view the available products, performing transactions commercials that are offered by the company ”GISELIDIAS.COM”.
1.4. SERVICE PROVIDERS: companies specialized (outsourced or not) in collections and payments via the internet, whose contracting will be exclusively under the responsibility of “GISELIDIAS.COM”, in order to effectively operationalize the system.
1.5. ASSISTANCE: Service provided by the company “GISELIDIAS.COM”, contracted by “GISELIDIAS.COM” to provide services involving the guarantees that guide the products made available by it.
II. OPERATIONALIZATION AND PROCEDURES
2.1. Only registrations of individuals who are regularly registered in the National Register of Individuals will be accepted, for all legal purposes.
2.2. Shipping and insurance payment will be calculated separately, and will be included in the checkout, according to the zip code selected by the final consumer for delivery of the product.
2.3. The logistics operator responsible for the entire transfer of the product (in international and national territory) will be the choice and responsibility of GISELIDIAS.COM.
2.4. The payment of amounts related to the commercial transaction will be made in the manner chosen by (a) BUYER (A) among those made available by “GISELIDIAS.COM”, indicated on the shopping site.
2.5. The BUYER undertakes to send to “GISELI DIAS”, if necessary and formally requested, all documents and information necessary to confirm the payment and provision of services under this contract.
2.6. Every product purchased on the website will be sent by “GISELIDIAS.COM” directly to (a) BUYER (A), as the name and address indicated by him/her in the electronic registration of the website.
2.7. In the event of a product defect, the BUYER must contact “CONTATO@GISELIDIAS.COM”, informing the occurrence.
2.8. In both cases, if the BUYER is in possession of the defective or wrongly sent product, he must send the product to “GISELIDIAS” after verifying the conditions of the product, avoiding that the (a) BUYER has any additional expense.
3.1. The prices informed on the website are already in “real”, and there may be changes at any time without prior notification; noting that the value corresponding to the taxes (60% II + 18% ICMS) charged by the BUYER’S “GISELIDIAS.COM” is included in the final price of the product advertised on the website, all of which is included in the closing of the purchase made via the internet by (a) BUYER (A).
3.2. “GISELIDIAS.COM” will issue a separate invoice for the provision of the service in question, in the amount mentioned above, which will be delivered to (a) BUYER, when requested by email.
IV. IMPORT TAX
4.1. Any import tax and/or other taxes that may apply to this commercial transaction are included in the advertised prices.
4.2. The amounts corresponding to the taxes will be paid by GISELIDIAS.
V. PRODUCT WARRANTY
5.1. The guarantees of products sold via the GISELIDIAS.COM portal follow Brazilian legislation and consumer protection code, and may be observed in the terms and conditions freely published on the website for consultation before the purchase intention
SAW. RETURNS WITHOUT FULL REFUND
6.1. “GISELIDIAS.COM” guarantees the full refund to the consumer in cases where the products are returned within the legal term. .
6.2.To request the Order Cancellation, it is necessary to contact our Contact Center CONTATO@GISELIDIAS.COM. But first, pay attention to the rules available on our “POLICY AND EXCHANGE” page. The BUYER of “GISELIDIAS.COM” undertakes to: a) pay for the products in the form and conditions set forth in this contract; b) ensure the accuracy of the information provided during the use of the service; c) to use the services provided by “GISELIDIAS.COM” only in the cases expressly provided for in this contract; d) to use the services provided by “GISELIDIAS.COM” only in the cases expressly provided for in this contract; e) follow the procedures defined in this contract in case of complaints, disputed deliveries or any other questions arising from the contracted services;
7.2. The obligations of “GISELIDIAS.COM”: a) post the purchased product within 7 working days after confirmation of payment; b) provide the necessary information about the product for its use; c) offer a guarantee of the products, such as repair or exchange, observing the deadlines informed on the website for each product, provided that no misuse is verified by (a) BUYER (A).
8.1. The responsibility of “GISELIDIAS.COM” is limited to the object of this contract.
IX. GENERAL PROVISIONS
9.1. “GISELIDIAS” may modify the Terms and Conditions of this Agreement at any time, and must publish the new version duly updated on the website within 5 (five) days following the introduction of the modifications.
9.2. The (A) BUYER (A) irrevocably and irreversibly authorizes “GISELIDIAS” to record and file the operations of (a) BUYER (A) relating to commercial transactions to use them as evidence before the administrative authorities and/ or judicial. For such purposes, the BUYER (A) and “GISELIDIAS” agree to grant it evidential value.
9.3. Both parties undertake to use their best efforts to amicably resolve disputes arising from any issue relating to the object of this contract.
